Lump sums for mesothelioma and vaccine damage in NI

The short answerIf you have diffuse mesothelioma from asbestos you were exposed to outside work as an employee, for example washing a relative's clothes, you may get a one-off lump sum: £120,566 if diagnosed at 37 or under, falling to £18,733 at 77 and over. Claim within 12 months of diagnosis. Severe disability from certain vaccinations can bring a £120,000 Vaccine Damage Payment.

If your exposure was at work as an employee, the Pneumoconiosis Order (NI) or a civil claim may apply instead; ask the Industrial Injuries Branch.

Diffuse Mesothelioma Payment

People with the asbestos-related disease diffuse mesothelioma may get a one-off lump sum if they cannot claim under the 1979 Pneumoconiosis Order (NI), have not been paid by an employer, a civil claim or elsewhere, and are not entitled to compensation from a Ministry of Defence scheme.

It covers exposure in the UK that was not from working as an employee: contact with asbestos through a relative, the environment, or self-employment. The amount depends on your age at diagnosis, from £120,566 at 37 and under to £18,733 at 77 and over.

Claims must be received within 12 months of the date of diagnosis. If the sufferer has died, their dependants may be able to claim. The claim form must be received within 12 months of the date of death.

Vaccine Damage Payment

If you’re severely disabled as a result of a vaccination against certain diseases, you could get a one-off tax-free payment of £120,000. Disablement is worked out as a percentage. 'Severe disablement’ means at least 60 per cent disabled. See Vaccine Damage Payment.

Disability premiums

If you have a disability and receive income-related Employment and Support Allowance, you may qualify for a premium on top of the basic personal allowance. You cannot get the severe disability premium if someone is getting Carer’s Allowance or the carer's element of Universal Credit for looking after you.

Disability benefits in Europe

When you live in an EEA state or Switzerland, you must still meet the entitlement conditions for the benefits you want to claim. Usually you must have spent at least two of the last three years in the UK.
