Disablement Benefit: compensation for a lasting work injury

The short answerIf an accident at work, on your commute, or an occupational disease leaves you with a lasting loss of 15% or more, Disablement Benefit compensates you. At 20% or more it's a weekly pension, up to €285 a week at 100%. Below 20%, it's a lump sum of up to €19,940. You can keep working.

It's paid on top of most other payments, including Jobseeker's, Disability Allowance and the State Pension. Claim within 3 months, or when your Injury Benefit ends, or you may lose money.

How it's assessed

A medical assessor rates your loss of physical or mental faculty. "Payment is only made where the level of disablement following the accident or disease is assessed at 15% or more." Examples: "Loss of both hands 100% Loss of one eye 40% Loss of thumb 30% Loss of 2 fingers of one hand 20% Loss of index finger 14%".

What it pays

"If you have 100% disablement , your maximum personal pension is €285." It scales down in steps, for example "- 50% €142.50" and "- 20% €57.00".

"Up to 19% disablement: A lump sum may be payable, up to a maximum of €19,940." "Disablement Gratuity is not taxable."

Extra payments

Incapacity Supplement, if you're permanently unable to work and don't get Illness Benefit: "Person under 66 €254 €168.60", personal and adult dependant rates.

Constant Attendance Allowance, at 50% or more disablement if you need daily help at home for 6 months: "Constant Attendance Allowance weekly rate in 2026: €271".

Working and other payments

"People getting Disablement Pension (without another payment) can work, full or part-time." "Disablement Benefit is a compensation payment and can be paid at the same time as most social welfare payments including Jobseeker's Benefit, Jobseeker's Allowance, Disability Allowance, Invalidity Pension, State Pension and One-Parent Family Payment."

How to claim

Off work? Claim Injury Benefit first, then Disablement Benefit before it ends. Still working? "You should claim within 3 months of the date of your accident or the onset of the disease." Use form OB21, to the Disablement Benefit Section in Longford, 0818 927 770.

Not disabled yet but worried? Tell your employer and ask the Department for a declaration that it was an occupational accident, to protect a future claim.
